Victory for man wrongfully arrested and abused

In early 2008, a Philadelphia man was walking down the street, minding his own business and speaking on his phone, when the police stopped him and stated they needed to speak with him. Concerned that he may owe child support and be detained, the man exercised his constitutional right not to stop and continued walking. The police attempted to grab him and the man sprinted. As the police began to chase him, allegedly, a woman stated to the police that he had a gun. He continued running and according to police, pointed the gun at them. The police shot at him three times and hit him once, and he fell to the ground. After falling, he continued trying to evade, but was eventually apprehended. Once caught, he allegedly told the police, “Why don’t you just kill me!” He was charged with Aggravated Assault on a Police Officer and Possession of a Firearm. No firearm was ever recovered, although the police claimed he threw the gun into the brush. He contacted attorney R. Emmett Madden to defend him in a trial by jury.

At trial, he was found not guilty of aggravated assault on a police officer and the jury hung on the weapons charge. At a subsequent trial, the Government agreed to withdraw all charges and after four long years, he was cleared.
