Wrongful death claims are similar to personal injury lawsuits

But in a wrongful death claim, it is the survivors of the victim who bring the claim against the person who caused their loves one’s death. Another difference is the type of damages available.

Personal injury claims have different damages that can be sought as compared to wrongful death claims. In a personal injury case, a plaintiff may be entitled to receive compensation for damages for: pain and suffering, loss in life’s pleasure, loss of consortium, disability and disfigurement, emotional suffering, and past and future medical costs and income losses. Another difference to be aware of in these types of actions is the distinction between a wrongful death action and a survival action. Again, in a wrongful death action the personal representative can seek damages for measurable expenses and the loss of the deceased’s companionship, care, and comfort, described above. On the other hand, in a survival action, it is similar to a personal injury claim. In a survival action, it is the cause of action that the decedent would have been able to bring if they had survived their injuries. For example, in a survival action, damages for the pain and suffering that the deceased endured before their death can be sought.
